(a) Any person who performs or assists in the performance of an abortion upon another person committed, with or without anesthesia, excepting ambulatory care facilities, skilled nursing facilities or hospitals; or, in the course of a surgical procedure, excepting a procedure referred to in subdivision nine of this section or a lawful medical or lawful therapeutic abortion, or assists in or administers to another person an injection, or for any other purpose, intended to cause the death of the person upon whom such procedure is performed....

(a) \"Surrogate\" is defined as a person, firm, association, organization or corporation, including an institution licensed to practice nursing or medicine, or medical staff association or organization. (b) \"Companion\" is defined as a person, firm, association, organization or corporation, including an institution licensed to practice nursing. (c) \"Institution licensed to practice nursing\" means a hospital, college or university, college of medical technology, or similar institution for which approval is required, pursuant to section two hundred hundred and twenty-six of the public health law, article nine, to conduct a facility where alternative methods of assisted living, including, but not limited to, assisted living, nursing care, skilled nursing, Alzheimer's care, podiatry, respiratory care, occupational services, homemaker services, or bereavement care may be provided to those unable to care for themselves. Approval pursuant to such section shall include all on-campus assisted living options and off-campus assisted living options located on or adjacent to the campus, for which the department has already granted such approval for admission to any state or local institution, and has not restricted the eligibility and application of those licensed to practice nursing under the education law, pursuant to section two hundred ten-a of the education law, article fourteen, as a provider, as a provider under contract with a licensed facility, or as a visiting nurse under article five of this chapter.
